Terms & Conditions
Please read these terms carefully before making a reservation with us.
These Terms & Conditions govern your reservation and stay at Birds Resort, Hambantota, Sri Lanka. By completing a booking, you confirm that you have read, understood, and agreed to these terms on behalf of yourself and all members of your party.
1. Reservations
- All reservations are subject to availability and are only confirmed upon receipt of a deposit or full payment as specified at the time of booking.
- A valid credit or debit card is required to guarantee your reservation.
- Bookings made through third-party platforms (e.g. Booking.com) are subject to the terms of those platforms in addition to ours.
- Birds Resort reserves the right to decline or cancel a reservation at its discretion, with full refund of any amounts paid.
2. Payment
- Room rates are quoted in US Dollars (USD) and are subject to applicable taxes and service charges.
- Payment may be made by major credit card, bank transfer, or cash in Sri Lankan Rupees at the prevailing exchange rate.
- Rates quoted at the time of booking are guaranteed for confirmed reservations. Rates are subject to change for new bookings.
3. Cancellation & Modification Policy
- Free cancellation is available for cancellations made more than 7 days prior to the arrival date, with a full refund.
- Cancellations made within 7 days of arrival will incur a charge equivalent to the first night's stay.
- No-shows will be charged the full reservation amount.
- Early departures may be charged for the full booked period.
- Modifications to reservations are subject to availability and any applicable rate differences.
- Special rates or promotional bookings may have separate, non-refundable cancellation terms which will be stated clearly at the time of booking.
4. Check-In & Check-Out
- Check-in time: 2:00 PM. Early check-in is subject to availability and may be arranged in advance.
- Check-out time: 12:00 noon. Late check-out is subject to availability and may incur an additional charge.
- A valid government-issued photo identification is required at check-in for all guests.
- Guests must be 18 years of age or older to check in. Minors must be accompanied by a parent or legal guardian.
5. Guest Conduct & Property Rules
To preserve the natural sanctuary and the experience of all guests:
- Noise levels must be kept to a minimum, particularly between 10:00 PM and 7:00 AM.
- Birds Resort is situated within a protected bird sanctuary. Guests must not disturb wildlife, remove plants, or venture into restricted areas.
- Smoking is permitted in designated outdoor areas only.
- Pets are not permitted on the property.
- The use of drones or recording equipment in restricted zones requires prior written consent from management.
- Birds Resort reserves the right to ask any guest to vacate the premises immediately, without refund, if their conduct is deemed disruptive, unlawful, or harmful to other guests, staff, or the environment.
6. Damage & Loss
- Guests are liable for any damage caused to the property, furnishings, or equipment during their stay.
- The cost of repair or replacement will be charged to the guest's account or payment card on file.
- Birds Resort is not responsible for the loss, theft, or damage of personal belongings. Guests are advised to use in-room safes and to exercise appropriate care.
7. Facilities & Services
- Access to resort facilities (pool, dining, experiences) is subject to availability and may be restricted for maintenance, private events, or seasonal closures.
- Dining reservations are recommended and subject to availability.
- Experience and excursion bookings are subject to weather conditions and minimum participant requirements. Refunds or rescheduling will be offered where activities are cancelled by Birds Resort.
8. Limitation of Liability
- Birds Resort shall not be liable for any indirect, incidental, or consequential loss or damage arising from your stay or use of our services.
- Our total liability to any guest shall not exceed the total amount paid for the reservation in question.
- We are not liable for circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, power outages, or wildlife activity inherent to the natural setting.
9. Privacy
Your personal data is collected and processed in accordance with our Privacy Policy, available at birdsresort.lk/privacy. By making a reservation, you consent to the processing of your data as described therein.
10. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
